Opening Brief Filed in Idaho General CAFO Permit Suit
On September 22, Snake River Waterkeeper and Food & Water Watch filed our opening brief with the 9th Circuit Court of Appeals. In addition to seeking meaningful permit requirements like having to monitor and report actual effluents discharged into rivers, we are arguing that EPA’s permit scheme unlawfully deprives citizens (and organizations like ours) of the right to hold CAFOs accountable through citizen lawsuits under the Clean Water Act – which are essential to ensure the public can defend water quality and waterway health.
