Comments submitted in Idaho state case against Simplot

In August 2025, the State of Idaho filed its own claims against Simplot over its decades of unchecked pollution at its Grand View concentrated animal feeding operation (CAFO). The state is seeking penalties (though they are far reduced from what we would have sought in our federal case) and is requiring Simplot to hold a pollution discharge permit in accordance with Clean Water Act standards. Their case was open for public comment through September 15; SRW worked with our expert witness, David Erickson, to file our comments (below). Regardless of the outcome of the State’s proceedings, we intend to continue monitoring Simplot’s CAFO for pollution violations and we intend to leverage the work we’ve completed in this case toward challenging other CAFOs in the state that are illegally discharging pollution into the Snake.
